These Terms and Conditions govern your access to and use of Fitle.
1Agreement
Fitle is operated by Andrii Kuts Mobile Inc. ("Fitle," "we," "us"), based in British Columbia, Canada. By downloading, accessing, or using the app, you agree to these Terms, our Privacy Policy, and our Community Guidelines. If you do not agree, do not use the app.
2Eligibility
You must be at least 13 years old, or the minimum age required by applicable law in your country (which is 16 in some parts of the EEA), to use the app. If you are under the age of majority, use the app only with permission from a parent or legal guardian.
3Accounts
Some features require an account. You agree to provide accurate information, keep it up to date, and maintain the confidentiality of your sign-in credentials. You are responsible for activity under your account.
4App features
The app may include onboarding, profile setup, personalized workout planning, daily plans, workout execution and tracking, history, progress features, an exercise library, reminders, HealthKit integration, community features such as circles, and free or premium features. Features may change over time.
5Health and fitness disclaimer
Fitle is not medical advice — use it at your own risk
The app provides fitness, workout planning, activity, and wellness-related information for general informational purposes only. Workouts, exercise selections, load suggestions, progressions, and other app-generated recommendations are suggestions, not medical advice, professional coaching, diagnosis, treatment, emergency services, or mandatory instructions. The app is not a medical device and is not a substitute for advice from a qualified healthcare professional. You are responsible for deciding whether any exercise, workout, recommendation, intensity, load, or progression is appropriate for your body, health, fitness level, injuries, medical conditions, and circumstances. Consult a qualified healthcare professional before starting or changing an exercise program, especially if you have injuries, pain, pregnancy, disability, heart disease, high blood pressure, diabetes, stroke history, or any other health concern. Stop exercising immediately and seek medical attention if you experience pain, dizziness, shortness of breath, fainting, chest pain, unusual discomfort, or other concerning symptoms. To the maximum extent permitted by law, you assume the risks associated with exercise and your use of app-generated fitness recommendations.
6HealthKit
If you grant permission, the app may read selected Apple Health and HealthKit data and may write completed workouts to Apple Health. HealthKit permissions are controlled by you through Apple Health or iOS Settings.
7Subscriptions and paid features
The app may offer premium subscriptions or paid features through Apple in-app purchases. Subscriptions are billed by Apple through your Apple Account and can be managed or cancelled in App Store account settings. Refunds are handled by Apple in accordance with its policies.
8Acceptable use
Do not use the app for unlawful, harmful, fraudulent, abusive, or unsafe purposes; attempt to access another user's account or data; reverse engineer or disrupt the app; or misuse workout, health, or fitness content in a way that may cause injury. When using community features, you also agree to follow our Community Guidelines.
9Your content & community
Fitle lets you post content in circles, such as messages, cheers, reactions, and profile details ("your content"). You retain ownership of your content. By posting it, you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute your content as needed to operate the app and its community features (for example, showing your message to the members of your circle). You are responsible for your content and confirm you have the right to share it.
To keep the community safe, members can report content and other members and block other members within a circle. We do not tolerate objectionable content or abusive behavior, and we may review, remove, or restrict content, and suspend or remove accounts, that violate these Terms or our Community Guidelines. You can also report content or a person to us at support@getfitle.com.
10Community Guidelines
Our Community Guidelines form part of these Terms and set the rules for behavior and content in circles. Serious or repeated violations may result in removal from a circle or termination of your account.
11Intellectual property
Fitle, including its name, logo, design, software, and content we provide, is owned by Andrii Kuts Mobile Inc. and protected by intellectual property laws. We grant you a limited, non-transferable, revocable license to use the app for personal, non-commercial purposes under these Terms.
12Privacy
Our Privacy Policy explains how information is collected, used, stored, and shared. By using the app, you acknowledge the Privacy Policy.
13Account deletion and termination
You may stop using the app at any time and may delete your account where available in the app. We may suspend or terminate access if you violate these Terms, create risk, misuse the app, or if we discontinue the app or relevant features. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — will survive.
14No warranties and limitation of liability
To the maximum extent permitted by law, the app and its content are provided as is and as available. We do not guarantee uninterrupted, secure, error-free, injury-free, medically appropriate, or health-outcome-specific operation. To the maximum extent permitted by law, we are not responsible for health issues, injuries, losses, or damages arising from your decision to follow, modify, ignore, or misuse workouts or recommendations, or arising from content posted by other members. You agree to indemnify and hold harmless Andrii Kuts Mobile Inc. from claims arising out of your content, your use of the app, or your violation of these Terms. Nothing in these Terms limits liability that cannot be limited under applicable law.
15Apple App Store terms
Required for the App Store
If you use Fitle on an Apple device, you acknowledge: these Terms are between you and Fitle, not Apple; Apple has no obligation to provide maintenance or support for the app; in the event of any failure of the app to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any), and to the maximum extent permitted by law Apple has no other warranty obligation; Apple is not responsible for addressing any claims relating to the app, including product-liability, regulatory, or third-party intellectual-property claims; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
16Governing law & changes
These Terms are governed by the laws of the Province of British Columbia and the applicable laws of Canada, without regard to conflict-of-laws rules, and you agree to the exclusive jurisdiction of the courts located in British Columbia, subject to any mandatory consumer-protection rights in your country of residence. We may update these Terms and will post the new date here; continued use of the app means you accept the changes. Questions? support@getfitle.com.
